PLEASE READ CAREFULLY: By accessing our website, submitting an enquiry, making a payment or enrolling in any of our courses, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions in their entirety. If you do not agree with any part of these Terms, please do not proceed with enrolment or payment.
1. Definitions
- School refers to Rishikul Yogshala, Rishikesh, Uttarakhand, India.
- Course refers to any Yoga Teacher Training Program (100/200/300/500 Hour YTTC), Retreat, or Short Course offered by the School.
- Student / Applicant refers to any individual who enrols in or applies for a Course.
- Advance Deposit refers to the initial non-refundable payment made to secure a seat in a Course.
- Batch refers to a specific scheduled session of a Course with defined start and end dates.
- Booking Date refers to the date on which the Advance Deposit is received and confirmed by the School.
- Batch Commencement Date refers to the official start date of the Batch in which the Student is enrolled.
- Written Intimation refers to a formal communication sent via email to contact@rishikulyogshalarishikesh.com.
- Official Channels refers to the School’s official website, official email addresses and authorised representatives only. Information received from any third-party agent, aggregator, blog or social media page is not binding on the School.
2. Eligibility & Admission
- The applicant must possess adequate mental and physical fitness to voluntarily participate in the Course. By enrolling, the applicant confirms personal accountability for this decision.
- Basic proficiency in the English language is a prerequisite.
- Applicants must be at least 18 years of age. Applicants aged 16-17 may be admitted with written parental/guardian consent.
- The School reserves the right to reject or cancel any admission at its sole discretion if the applicant is found to be unfit, provides false information or fails to meet eligibility criteria. In such cases, the Advance Deposit shall stand forfeited.
- Admission is confirmed only upon receipt of the Advance Deposit and a written booking confirmation from the School.
3. Code of Conduct
The School is a place of learning and discipline, not a holiday resort. By enrolling, students agree to uphold discipline and respect the yogic lifestyle throughout the duration of the Course.
3.1 Student Responsibilities
- Attend all scheduled classes, sessions and activities.
- Respect teachers, staff and fellow students at all times.
- Maintain punctuality and active participation.
- Inform the School in advance of any leave due to emergency.
- Return to campus by 9:45 PM. Gates close at 10:00 PM.
- Maintain silence during meals and sessions.
3.2 Prohibited Conduct (includes but is not limited to)
- Consumption of alcohol, tobacco, drugs, non-vegetarian food, or intoxicants on campus or during course hours.
- Disrespect, bullying, harassment, sexual misconduct or any form of offensive behaviour towards students, staff or faculty.
- Damage to School property or disruption of the school environment.
- Practice in swimwear/bikinis or any form of public nudity.
- Mobile phones must be switched off inside the yoga hall. No electronic devices are allowed during classes.
- Photography, video or audio recording during classes is not permitted without prior written permission.
3.3 Disciplinary Action
Failure to adhere to the above rules may result in one or more of the following actions at the School’s sole discretion:
- Verbal warning and counselling.
- Temporary suspension from classes.
- Permanent dismissal from the Course without any refund, adjustment or transfer of fees paid.
The School’s decision on disciplinary matters shall be final and binding.
4. Attendance, Participation & Certification
4.1 Attendance Requirements
- Students must attend all classes, sessions and training activities as per the published schedule.
- A minimum attendance of 90% is mandatory for certification eligibility.
- Unauthorised absences may affect certification eligibility.
4.2 Examinations
- Final examinations include practical, written and/or multiple-choice assessments.
- Failure to participate in the examinations or incomplete submissions shall result in non-issuance of the certificate.
- Students who do not pass the examination may request one (1) re-examination opportunity within the same Batch, subject to faculty availability. Any re-examination beyond the Batch period is not available.
4.3 Certification
- Certification is contingent upon successful completion of all academic and practical requirements, including minimum attendance, examinations and adherence to the Code of Conduct.
- Full payment of the Course fee does not automatically guarantee the issuance of a certificate. Certification must be earned through the requirements stated above.
- Yoga Alliance registration eligibility is subject to meeting Yoga Alliance’s independent requirements and is outside the School’s control.
5. Payment Terms
5.1 Advance Deposit
- To confirm a booking, a 20% advance deposit of the total Course fee is required.
- The Advance Deposit is strictly non-refundable under all circumstances. Please refer to Section 6 for complete details.
- This deposit secures the Student’s seat, accommodation, staffing, teachers and administrative arrangements for the selected Batch.
- The Advance Deposit may be collected at any time prior to the Batch Commencement Date, including for Batches scheduled months in advance. Regardless of when the deposit is paid, all terms herein apply from the date of payment.
5.2 Accepted Payment Methods
The following payment methods are accepted for both Advance Deposit and balance payments:
- Cash: USD (US Dollar), EUR (Euro), INR (Indian Rupee).
- Credit/Debit Card: Subject to a 5% bank transaction surcharge.
- Bank Transfer: Contact the management team for banking details. Transfer fees, if any, are borne by the Student.
- UPI (India): Available for INR payments on campus.
5.3 Balance Payment
- The remaining balance of the Course fee must be paid within 2 (two) calendar days of arrival at the School.
- Failure to complete the balance payment within the stipulated time may result in cancellation of enrolment and forfeiture of the Advance Deposit.
- The 5% card surcharge applies to balance payments made via Credit/Debit Card as well.
5.4 Currency & Exchange Rate
- All Course fees are quoted in the currency listed on the School’s official website at the time of booking.
- For cash payments in foreign currencies (USD/EUR), the exchange rate applicable on the date of payment at the School shall apply. The School is not responsible for exchange rate fluctuations.
6. Cancellation, Refund & Transfer Policy
IMPORTANT: The Advance Deposit is non-refundable under all circumstances. There are no exceptions to this policy. The only relief available is a one-time Batch transfer, subject to the conditions outlined below.
6.1 Non-Refundable Advance Deposit
The Advance Deposit shall not be refunded, adjusted or set off against any other fee, service or future booking under any circumstances, including but not limited to:
- No-show or failure to arrive on the Batch Commencement Date.
- Late arrival (arriving after the Batch has commenced).
- Early departure for any reason (personal, medical, visa, or otherwise).
- Unused days or services.
- Change of plans, personal circumstances or change of mind.
- Visa denial, travel delays, flight cancellations or missed connections.
- Illness, injury, hospitalisation or medical emergencies.
- Pandemics, epidemics, government restrictions, lockdowns or travel bans.
- Natural disasters, acts of God or force majeure events.
6.2 Batch Transfer (One-Time Only)
If a Student is unable to attend the Batch for which the Advance Deposit was paid, the deposit may be transferred one (1) time only to a different Batch, subject to ALL of the following conditions:
- The transfer must be requested via Written Intimation (email to contact@rishikulyogshalarishikesh.com).
- The transfer must be to a Batch commencing within 12 (twelve) months from the original Booking Date.
- For transfer to the immediate next Batch: Written Intimation must be received at least 15 (fifteen) days prior to the Commencement Date of the originally booked Batch.
- For transfer to any subsequent/later Batch: Written Intimation must be received at least 30 (thirty) days prior to the Commencement Date of the originally booked Batch.
- The transfer is subject to seat availability in the requested Batch. The School does not guarantee availability.
- If the fee for the new Batch is higher than the originally booked Batch, the Student must pay the difference. If lower, no refund of the difference shall be provided.
- Once a transfer is availed, no further transfer, cancellation, or adjustment of the Advance Deposit is permitted under any circumstance.
6.3 When Transfer Is NOT Available
The Batch transfer facility shall NOT be available in the following cases:
- The Student has already joined or commenced the Course (even partially, including attending the orientation or first session).
- The required notice period (15 or 30 days as applicable) has not been met.
- A transfer has already been availed once previously.
- The 12-month window from the original Booking Date has expired.
- The Student was dismissed for violation of the Code of Conduct.
6.4 Late Cancellation / No-Show
No refunds shall be provided for cancellations at any stage or no-shows. If a valid transfer request has not been submitted per Section 6.2 above, the Advance Deposit shall stand forfeited.
6.5 Early Departure
- If the Student leaves the Course early for any reason, no refund, adjustment, credit or transfer shall be provided for the remaining period.
- Accommodation, meals and services already availed shall be considered consumed and are non-refundable.
- If the Student has not yet paid the full balance and departs early, the School reserves the right to charge for services rendered at the applicable daily rate.
6.6 School-Initiated Cancellation or Rescheduling
In the rare event that the School cancels or reschedules a Batch due to operational reasons (such as insufficient enrolment, instructor unavailability, or facility issues):
- The Student shall be offered a full transfer of the Advance Deposit to the next available Batch at no additional cost.
- Alternatively, if the Student is unable to attend any alternative Batch within 12 months, a full refund of the Advance Deposit shall be processed within 30 business days.
- The School shall not be liable for any travel costs, visa fees, accommodation bookings, or other expenses incurred by the Student in anticipation of the cancelled Batch.
6.7 Force Majeure
Neither party shall be liable for failure to perform obligations under these Terms if prevented by circumstances beyond reasonable control, including but not limited to natural disasters, floods, earthquakes, pandemics, epidemics, government orders, war, civil unrest, or utility failures (“Force Majeure Event”).
In the event of a Force Majeure Event affecting the delivery of a Course:
- The School shall make reasonable efforts to reschedule the affected Batch.
- Students affected shall be offered a transfer to the next available Batch at no additional cost.
- No cash refunds shall be issued for Force Majeure cancellations, except where the School is unable to offer an alternative Batch within 12 months, in which case a refund of the Advance Deposit (only) shall be processed.
- The School shall not be liable for any consequential costs including travel, visa, accommodation, or other expenses.
7. Course Fee - What’s Included & What’s Not
7.1 Included in the Course Fee
- Tuition and all scheduled classes/sessions.
- Accommodation for the duration of the Course (as per selected room type).
- Daily vegetarian meals (breakfast, lunch, dinner) as per the published schedule.
- Study materials, manuals, props, neti pots and learning resources.
- Certificate upon successful completion (subject to Section 4.3).
7.2 NOT Included in the Course Fee
- Travel expenses (flights, trains, taxis, etc.).
- Personal expenses (laundry, phone, excursions, shopping, etc.).
- Travel, health or flight cancellation insurance. Students are strongly advised to arrange comprehensive insurance before travel.
- Any medical costs arising during travel or stay.
- Visa fees and processing charges.
- Extra accommodation or meals beyond the Course period.
- Any costs arising from early departure, extension of stay or additional services not included in the published Course itinerary.
8. Accommodation & Facilities
- Rooms are allocated based on booking type and availability.
- The School reserves the right to change room allocations due to operational or maintenance reasons. In such cases, an equivalent or better room shall be provided where possible.
- Visitors are not allowed in student accommodation without prior permission from the administration.
- Anyone staying on campus beyond the Course duration shall be charged at the applicable daily rate for food and accommodation.
- Damage to School property shall be chargeable to the Student at replacement/repair cost.
- Valuables and personal belongings are the Student’s sole responsibility. The School is not liable for loss, theft or damage of personal items.
9. Safety, Health & Medical
- Students must disclose any pre-existing medical conditions, injuries, allergies, physical limitations or mental health conditions at the time of enrolment and prior to arrival.
- Failure to disclose relevant medical information may result in dismissal without refund if the condition poses a risk to the Student or others.
- Basic first aid is available on-site. For medical emergencies, the School will assist in arranging transport to the nearest medical facility. All associated medical and transport costs shall be borne by the Student.
- Rishikul Yogshala is not liable for any health-related issues, injuries, allergies, aggravation of pre-existing conditions or accidents incurred during the Course or stay.
- Students should carry adequate personal medication for any ongoing conditions.
- Students are strongly advised to obtain comprehensive health and travel insurance prior to arrival.
10. Privacy, Data Protection & Media Consent
10.1 Media Consent
- By enrolling, Students grant Rishikul Yogshala a non-exclusive, royalty-free, worldwide licence to use photographs and videos captured during the Course for promotional, marketing and educational purposes, including on the School’s website, social media accounts, printed materials and advertising.
- This licence does not extend to the sale or transfer of media to unaffiliated third parties for their independent commercial use.
- If a Student wishes to withdraw media consent, they may do so by sending Written Intimation to contact@rishikulyogshalarishikesh.com. The School shall make commercially reasonable efforts to remove the Student’s identifiable images within 60 (sixty) days of receiving such request, except where images are already in printed materials or archived content.
10.2 Personal Data
- Personal data collected during enrolment (name, email, phone, passport details, medical information) shall be used for official communication, administrative purposes and school-related activities only.
- The School shall not sell personal data to third parties.
- Students may request access to, correction of, or deletion of their personal data by contacting contact@rishikulyogshalarishikesh.com.
11. Website & Intellectual Property
- Use of the School’s website signifies acceptance of these Terms & Conditions.
- All intellectual property, images, text, logos, course content and resources on the website are owned by Rishikul Yogshala and may not be reproduced, copied, or reused without prior written permission.
- Only information published on the School’s official website and confirmed via official email constitutes a binding representation by the School. The School is not responsible for information appearing on third-party websites, review platforms, social media pages, or agent/affiliate communications that may be inaccurate, outdated, or unauthorised.
12. Limitation of Liability
- Rishikul Yogshala’s total liability under these Terms, for any claim whatsoever, shall not exceed the total Course fee actually paid by the Student to the School.
- The School shall not be liable for any indirect, incidental, consequential or punitive damages, including but not limited to loss of income, travel costs, visa fees, accommodation costs or emotional distress.
- The Student acknowledges that yoga and related physical activities carry inherent risks and participates voluntarily, assuming full personal responsibility.
13. Governing Law & Dispute Resolution
- These Terms are governed by and construed in accordance with the laws of India.
- In the event of a dispute, both parties shall first attempt resolution through mutual consultation and good-faith negotiation for a period of 30 (thirty) days.
- If unresolved, the dispute shall be referred to a sole arbitrator appointed mutually by both parties. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996 (as amended), with the seat of arbitration in Dehradun, Uttarakhand, India.
- The courts of Rishikesh, Uttarakhand, India shall have exclusive jurisdiction for any matters not subject to arbitration.
- For international Students: By enrolling, you consent to the applicability of Indian law and the jurisdiction specified herein and waive any objection to venue or jurisdiction.
14. Grievance / Complaint Redressal
- If you have any concerns or complaints related to classes, teachers, accommodation, cleanliness, food, or staff, please report them directly to the Student Coordinator at the School.
- We kindly request students to raise concerns during their stay so that they can be addressed promptly. Our standard resolution time is 24-48 hours.
- Complaints related to on-campus experience (food, accommodation, classes, staff) should be raised during the Course. Such complaints raised after Course completion may not be entertained.
- Complaints related to certification, payments, data privacy or billing may be raised at any time by emailing contact@rishikulyogshalarishikesh.com and shall be addressed within 15 business days.
- Rishikul Yogshala is committed to addressing genuine concerns in a fair and timely manner.
15. Amendments
Rishikul Yogshala reserves the right to modify or update any part of these Terms & Conditions. The updated Terms shall be published on the School’s official website with a revised “Last Updated” date. Students are advised to review the Terms periodically. The Terms in effect at the time of the Student’s Booking Date shall govern that booking, except where amendments are required by law.
16. Entire Agreement
These Terms & Conditions, together with the booking confirmation issued by the School, constitute the entire agreement between the Student and Rishikul Yogshala. No verbal assurances, WhatsApp messages, social media posts or representations made by any person (including School staff, agents, or affiliates) shall override or modify these written Terms unless confirmed in writing by the School’s authorised management via official email.
DISCLAIMER
At Rishikul Yogshala, the safety and wellbeing of our students are of paramount importance. Our yoga teacher training programs, retreats and related activities are undertaken voluntarily and all participants are encouraged to ensure they are physically and medically fit before joining. If you have any pre-existing health conditions, please consult a healthcare professional prior to arrival.
While our team is committed to providing a supportive and secure environment, participation in yoga and related practices involves personal responsibility and inherent physical risk. Rishikul Yogshala shall not be held liable for injuries, illnesses, loss or damage of personal belongings, travel disruptions, or unforeseen circumstances beyond our control.
Course schedules, services and program details may occasionally be adjusted to maintain the quality and smooth operation of the training experience. Such adjustments shall not constitute a breach of these Terms or entitle the Student to any refund or compensation.
By proceeding with your enrollment and/or making a payment, you confirm that you have read, understood and agreed to all of the above Terms & Conditions.
